When submitting an offer to purchase a home, in Florida there are two contracts that we use. The AS IS and The Residential Purchase Contract. These two contracts are extremely different in the requirements for both buyer and seller. There are time frames in which certain tasks are to be completed and ramifications to the party if they do not complete. We will just look at repairs for now.
Under the AS IS the repair limit is $0.00, now as a seller you would think that if anything comes up on the inspection I do not have to make the repairs. Which in fact is true. Now think about this. Since we are in Florida in our example we will say that the AC is not working properly and the inspector says something to the effect that the AC should be evaluated by licensed AC Company. The buyer can cancel the contract based on the inspection results as per the contract.
They also can come back to you as the seller and say we want you have the AC inspected by a licensed AC Company and have what repairs and or replaced as needed. And then they require that you as the seller provide copy of the diagnosis and proof that the issue was repaired or replaced. Now you are probably are saying but is an AS IS contract. Yes that is true, but lets say you say no I am not going to make any repairs. And if you do not make the repair to remedy the AC it will be an issue for all subsequent offers and inspections. The easiest way to say it is. If you do not fix it and will not get fixed.
